What is Administrative Law?
To put it simply, administrative law is the legal framework that deals with the administrative aspect of governmental agencies working at both state and central level. It is the guideline that governmental bodies need to adhere to while exercising public administration. The rulemaking authority put in place to ensure that the people in authoritative positions in the structure of the government body do not abuse their power. To ensure and ascertain that public welfare is the ultimate goal.
Administrative law: A Brief History
Upon observation, it was learned that administrative law is not a new concept but in fact traces of it have been seen in almost every legal system that was being put in practice long before the constitution and the judiciary systems were set and certified. In India, the Mauryas, the Guptas, the Mughals and then later on the British all seem to implement and practice elements of the current administrative law.
There are many definitions of administrative law provided by many learned individuals with an enhanced understanding of the concept and field. One of the broadest and widely known definitions are given by Ivor Jennings who defined the term Administrative law in ‘The law and the constitution,1959’.
According to Jennings, “Administrative law is the law relating to the administrative authorities”. He further defined Administrative Law as “the law relating to the administration. It determines the organization, powers, and duties of administrative authorities”.
However, these definitions, no matter how broad or crisp they seem in words, merely give an idea of what the concept of administrative law entails as this law is not that of a written in stone and rigid nature. It is a constantly evolving and transforming guideline that provides boundaries, promotes a healthy relationship between the governmental agency, or authority and the citizens or individuals and determines a controlled framework within which the governmental authorities are to function accordingly. The various fields include centre criminology, socio legal studies, human rights law, European comparative law, etc.
